Temporarily Solving Problem in The Imports of Used Machinery and Technological Lines

The problem of businesses and local Customs departments related to the time limit for implementing regulations on the imports of used machinery and technological lines has been solved. After being directed by the Government on this problem, the General Department of Vietnam Customs issued an official letter to instruct municipal and provincial Customs Departments to implement.

Recently, the Government issued Resolution 162/NQ-ND at the Government Conference with localities and Government monthly meeting in December 2018. Point 8 of Resolution 162/ NQ-CP provides that “the Government shall unify to continuously apply regulations at Clause 6 Article 72 of Decree 69/2018/ND-CP on the imports of used machinery, equipment and technological lines until the Prime Minister's Decision stipulating this content is valid. Assigning the Ministry of Science and Technology to chair and coordinate with the Government’s office to urgently complete the draft Decision to submit it to the Prime Minister for promulgation.

Accordingly, the General Department of Vietnam Customs has requested municipal and provincial Customs Departments to base on the contents in the Resolution 162 to handle the import procedures for used machinery, equipment and technological lines in accordance with regulations.

Previously, a number of local Customs departments have reflected shortcomings when carrying out procedures to import used machinery, equipment, and technological lines. Because, Circular 23/2015/TT-BKHCN was invalid since 31st December 2018.

According to Clause 5, Article 8 of Decree 69/2018/ND-CP, “the imports of used machinery equipment, and technological lines shall be complied with the Prime Minister’s Decision”. However, currently, the Prime Minister still has not yet issued regulations on the implementation for these import procedures.

Thus, the import procedures of used machinery, equipment and technological lines from 1st January 2019 have not yet been specifically instructed. Whether the over 10 year-used machinery and equipment and technological lines are allowed to import or not? Whether the imported used machinery and equipment must be inspected for conformity of standards or not?
